          It always amazes me when I see a chart like this one. It is hard to believe that we live in one of the most dangerous country’s in the world. I have traveled to at least 75% of the states in our country and it seems the only times that I may be concerned for my safety are in certain big cities. High crime areas. 

          Looking at the data that was given to us we see that the United States is by far the biggest in population, second biggest when it comes to land mass, and one of the highest practicing countries of a religion. We also have one of the greatest amount of different ethnic backgrounds in the world. When you put all these together with the guns in the mix you are going to have some problems. Not that guns are a bad thing. I believe we need them in the hands of law abiding citizens. But when you have such a vast difference in income class levels and the amount of money that our country has, you’re going to see problems arise. When people struggle to live with little food, bad health situations, and a low income, that most of the time does not even provide for their families, they will turn to crime. 

            When it comes to our Gross Domestic Product per capita (GDP) and guns per 100 residents it makes a whole lot of sense why we are an outlier as the sixth most dangerous country in the world. With there being such a difference in income levels it usually leads to crime with the use of a gun. It has to do with our freedom, which of course is not a bad thing. I believe this is a huge reason for the number of guns that our country possesses. We have more access and freedom to buy guns then any other country in the world. Just about anyone can get a firearm in the United States legally or illegally. When that is the case people will arm themselves for protection. The average home in the United States that possess guns legally, probably ranges from 3-5 in each home. 

              Our country needs to spend more time educating individuals of how important guns are, if used and handled properly by the right people, we would probably see a decrease in deaths. As long as we continue to grow in numbers and income so will our crime. We just need to be prepared with better trained law enforcement and making citizens aware of their rights.

You are a social worker in a program with in a non-government agency that supports people recovering from addiction. Steve, a 23 year old man presents at your service as he has been has a upcoming Court date for some drug related offences and his lawyer  told him if he attends a course it will prevent him from going to prison.

Steve has a long history of alcohol and marijuana addiction as well as several prior convictions for theft and burglary. Notifier stated they have continued to experience difficulties in following-up health issues for the children because family spends large amounts of time at their Outstation and there is no service outreach to this location.  Previous involvement with the family has resulted in two (2) hospitalisations for Stephen and Mary for failure to thrive and each time their weight had increased on their return to community however contact is lost when family moves to the outstation. Notifier added that b/mo Jeanie has disclosed that there is often little to no food available at the Outstation as it runs out quickly.  Jeanie presents as disempowered when discussing family issues with the health centre and her own serious malnourished state supports the view that her nutritional needs take low priority in the family hierarchy.  The health centre has had no direct involvement with the birth father as he never accompanies Jeanie or the children to their service. Criminal Law Emily

 

 Michelle and Stacey were roommates. Michelle had a boyfriend named Steve. Stacey did not like Steve very much. She found him to be ignorant and thought he drank too much. Stacey also did not like the way Steve treated Michelle. One night Stacey game back to the apartment and found Steve stabbing Michelle in her chest over and over yelling, “how could you do this to me Michelle, I love you with all my heart, how could you.” Steve was visibly drunk. Stacey walked over to her desk drawer and pulled out a gun and stated, “I have had enough of you Steve.” Stacey shot Steve straight in the heart and he died. Moments later Michelle got to her feet and took the knife Steve was stabbing her with and stabbed Stacey in the chest several times yelling, “I loved him, how dare you.”

Discuss the crime(s) Stacey and Michelle would be guilty of using the model penal code.

Stacey and Michelle are both caught in this odd scenario where they respond emotionally to the events that are occurring. Stacey found a good justification to finally get rid of Steve who she already strongly disliked however Michelle responded in a fit of passion. In Stacey’s scenario she had enough time to walk over where she new a weapon was and make the decision to shoot Steve and have the intent of killing him. Michelle’s response isn’t so calculated its more a knee jerk response.

The two differences are important. The Model Penal Code has two classifications intentional and unintentional. There are subcategories to these which are purposefully, knowingly, recklessly and negligently. The first two belong with the intentional category and the last two belong with the unintentional. Stacey had intent to kill Steve and she purposefully and knowingly did it. Michelle on the other hand was reckless and negligent in her response. [1]

Since the Model Penal Code was created some states have decided to expand on it, for example Oregon. Oregon expanded on voluntary manslaughter and the defense heat of passion is now used often. In this instance I could easily see the heat of passion defense being used in this case to protect Michelle who had not only just been stabbed by her boyfriend but then seen him shot. I believe in this instance both would be charged with voluntary manslaughter but one would have a stronger defense than the other. [2]
