Case One

A police officer who works near a local airport observes a car speeding on the road leading into the airport. He stops the car and approaches the vehicle, where he sees a man alone in the driver’s seat and his suitcase in the back seat. The traveler is sweating profusely, and keeps telling the officer he is in a hurry to catch a flight. The officer asks the traveler if he can search his luggage, and the man says yes. When the officer unzips the bag and starts the search, the man changes his mind and says no. At that point, the officer leaves the bag unzipped but still laying on the back seat where the contents are not visible. He calls for another officer to bring a drug detection dog to the site. The other officer and the dog get called to a more urgent search and don’t appear. The traveler asks to leave, which the officer says is ok, but he won’t let him take his bag. The traveler refuses to catch his plane, and asks for an attorney.

Analyze this case from both the traveler’s and the police officer’s perspective. What constitutional rights are at issue? Have any of them been violated?

Case Two

A police officer observes a motor home driving erratically down a main street at 10:00 a.m. She is concerned that the driver may be impaired by alcohol or drugs. When the officer approaches the driver’s side of the vehicle, the window is down and she can smell a strong marijuana odor. She also observes two other people in the vehicle, a woman in the front seat and a man in the middle of the mobile home sitting at a table. She also observes a clear plastic bag on the table with a white powdery substance inside. What can the officer do next based on these facts? Be specific in your answer.

Case Three

The Patriot Act, as originally passed and amended, significantly increased the ability of law enforcement to use search and surveillance procedures in the investigation of activities in the United States in the interest of national security and preventing terrorism. One provision of the Act, Section 213, is known as the “sneak and peek” provision. The provision provides law enforcement with warrants to enter a suspect’s house, and look for records on their personal computers, without notifying the suspect a search has occurred. This provision has also been used to investigate crimes other than terrorism, such as drug and fraud cases. Evaluate the pros and cons of this law, and include in your analysis the constitutional provisions that are affected.

Every organization within the field of criminal justice has a management hierarchy of some sort. Included among the many tasks assigned to managers are budget planning, financial decision making, and effecting personnel decisions. However, what is missing at times in criminal justice agencies is effective leadership. Too often policy makers confound leadership with management. The two can be, and often are, quite dissimilar.

In the City of New Orleans immediately after Hurricane Katrina, a variety of political and local managers and leaders congregated in the Central Business District in an effort to arrive at a consensus as to the wisest course of action. Among those present was Michael Brown, the director of FEMA, Ray Nagin, the Mayor of New Orleans, and various state politicians. No action plan could be developed as each respective politician was so focused on their own needs that they soon became blinded to effective alternatives. Added to those problems were the combined effects of serious deficiencies in communication and coordination of rescue efforts.

I feel that the best way to handle gangs and related special populations should start with a two-pronged approach. The first would be a cooperative effort between school, law enforcement and other social or youth related services to provide stronger outreach and prevention methods through education, awareness and youth activity programs. I would argue the second step would be proactive gang enforcement. This could be done by using police and probation resources to provide for an intensive supervision program that would allow for gang monitoring and intelligence information. I would argue though controversial, a unit like the LAPD’s CRASH Unit of the 1990’s would be a good idea. The overall concept worked and reduced crime before the corruption scandals. As it pertains to the 3 factors that would shape the juvenile offenders to join gangs is first, it provides a sense of belonging to a group, in some cases acts as families for the gang (Taylor, Fritsch, 2011).  The second is that it provides for a way for a youth to obtain money through drugs and other crime, the last reason is that friends join gangs and they want to belong (Taylor, Fritsch, 2011).

As it pertains to a long term juvenile correctional facility, I would argue that these 5 items are needed to ensure success and functionality of the facility. The first thing that is needed for a successful long-term facility is security.  If the facility is not secure, then escapes can occur and if a juvenile is not in secure custody correctional treatment cannot begin. The next step is that it must have competent staff, this is staff who has been background checked and trained in correctional law and use of force. This ensures that security functions properly and that those who harm children are not employed and that up to date training is provided. The next step is a successful treatment team, this will ensure that programs and treatment is available for issues related to criminal or delinquent activity such as substance abuse and mental health. The next area needed is education to ensure that the juvenile can still learn and have a chance to develop knowledge and skills that can be used after release from detention. The final item is medical care, this will reduce cost from outside medical trips resulting in reduced transport cost and staff safety issues. In addition, this provides earlier intervention for illness or injury treatment in opposed to waiting for outside intervention. I would argue that these services need to be set up in a prison style fashion to ensure secure custody and control of the juvenile. If a juvenile need to be in a detention setting, they are a risk to the public or there self and a risk of escape needs to be mitigated which can be done with secure custody.

Sexual  violence is a crime that happens far too often and to many women and  men. Approximately 1 in 4 women and 1 in 6 men have been sexually abused  and out of those statistics only 28% of the victims report the crime  (The Center for Family Justice, n.d.). The truth is inevitable, rape is a  vert common crime, but what makes someone want to sexually abuse or  rape a person? There are different theories that are believed, as to why  someone would be sexually deviant, some believe it is biological while  others believe it is psychological. Biological theorists believe that  the acts of sexual deviance are because someone is born with them and  psychological theorists believe that outside factors such as, trauma,  what is learned through social interaction and development. Biological  theorists believe there is an impulse that causes someone to be sexual  deviant and also believe that a man who is susceptible to be sexually  abusive may also have the capabilities to produce a larger number of  children, but there other biological theorists that believe that it is  more of a want, the want to achieve a certain number of sexual partners  (The Advocates for Human Rights, 2006). There are various perspectives  that focus on the psychological aspect of rape and sexual abuse.  Researchers will often look into the offender’s past life to determine  what made offender decide to commit such an act. 

 `When  it comes to the explanation on sexual deviance and whether the act is a  result of biological or psychological, there is not one perspective  that is right. Each and everyone of our thought processes are different  because we are different, so a sexual offender and their choice to be  sexually deviant can have a multitude of variables that affect their  decision, but I do not believe someone is born to commit such sexually  deviant acts and that some kind of trauma or it’s something an offender  has learned because they have viewed such an act and were essentially  taught that the act itself if normal. There a many variables that can  affect someone’s choice to commit a crime such as rape or sexual abuse  and oftentimes it takes great research to determine the why of such  awful situations.

One direction is to main-stream the problem children in hopes that by surrounding them with pro-social peers, they will see what is acceptable and unacceptable behavior and conform.  Another approach is to isolate them in special schools designed to handle discipline issues while concentrating the problem children into a single location.

As it pertains to problem students, I would make the argument that they should remain with peers in a pro social environment.  I can recall in 2002 when I was a sophomore in college I worked as a school district police officer part time for about two and a half years. I was able to deal with and see up close the role that peer, and pro social behavior played in positive development of troubled kids. The approach in the district I worked was to keep kids in the school, they would get suspended and a criminal summons for fighting but still stayed in regular school. If a student became too violent or became too much of a discipline issue, they were sent to an intermediate unit school.  While I did not work at this type of school, I knew officers that did and dealt with some of the students. This type of school was filled with students that relied on bad and criminal behavior and I feel was a training ground for juvenile detention or jail later in life. I feel that in regular school even if I filed criminal charges against a juvenile, I could still see them and keep an eye of them and be a positive role model along with teachers and friends. The alternative form of education did not offer this approach which is why I feel it would have more of a negative impact.
