Biological and Psychological Theories of Crime

There are many reasons why a person commits a crime and many criminology theories from different disciplines attempt to explain the underlying reason for such behavior. Psychological theories point to abnormal or dysfunctional mental processes in a person’s personality. Although, it is important to take into consideration conditioning, role models, and the degree to which a person is acclimated to the norms of society that impact a person’s psychological make-up. Similarly, a biological perspective may attribute a person’s biology as the route cause of criminal behavior. Consider a man arrested on assault charges. His father is in prison for murder, his brother incarcerated due to drug charges, and he has paternal alcoholic uncle who is a registered sex offender. Proponents of biology theories may suggest a hereditary link between the men and criminal behavior. Although these are not the only theories that attempt to explain crime, they are important to consider as possible causes of crime and criminal behavior.

Larry Landlord has recently renovated an apartment and has put it on the market to be rented for $800.00 a month

Larry Landlord has recently renovated an apartment and has put it on the market to be rented for $800.00 a month. Larry Landlord has been in business for approximately five (5) years and has had both positive and negative experiences with tenants. Larry Landlord is hoping to find a good, long-term tenant for his apartment. Roger Renter saw Larry’s sign for the apartment for rent and thought the location and the apartment would be perfect. Roger met Larry to look at the apartment and Roger fell in love with it. All of the interior fixtures had been replaced and the unit had a nice large closet. Roger noticed that although newly painted, the exterior of the apartment did show a little bit of wear. Because of the condition of the exterior of the building, Roger asked Larry about any roof leaks. Larry stated that he had never had a leak and was not aware of any leaks.

Roger and Larry entered into a valid contract for the rental of the apartment. (Note: The issue of whether or not a contract exists is NOT part of this question. For purposes of this question assume the contract is valid and there are no issues with the contract.)  

Roger Renter was very happy in his new location; the apartment was quiet and the neighbors were friendly. Larry Landlord was also very happy because Roger Renter was a model tenant. Roger Renter paid on time and was quiet and respectful to other tenants.

The part of the country where Roger rented was rainy in the summertime. Roger rented and moved into the apartment in October. In June, a tremendous rainstorm occurred and Roger’s roof began to leak. The leak was minor at first and Roger merely put a trash can under the leak and had no other issues that month. When handing over his monthly rent check, Roger told Larry about the small leak. Larry thanked Roger for letting him know about the leak and told Roger he would have it fixed. 

The next month the rains came again and the leak grew larger in Roger’s apartment. Roger was not home at the time of the rain and therefore the leak damaged some of Roger’s furniture. Roger called Larry to let him know that there was a leak and asked when it might be fixed. Roger also stated that he thought Larry had fixed the roof. Larry curtly stated, “When it rains, sometimes it pours. When it pours, sometimes it leaks.” Roger did not like Larry’s tone or response and called back to ask when the roof might be fixed. Larry stated, “When I get to it.” The following day, Roger sent Larry a note about the roof leak and asked Larry to please address the issue.

The week before the rent was due, another rainstorm occurred and the leak was even larger. This time the leak damaged Roger’s clothing, furniture, and some precious items he had inherited from family members. Roger called Larry and asked Larry to fix roof immediately. Larry responded in a similar and condescending manner. Roger hung up the phone and threw his baseball bat against the wall, damaging the drywall and knocking out an electrical socket.  

Since it was the rainy season, Roger knew it would rain again and therefore simply moved his items away from the leak and did nothing to help mitigate the damage from the leaking roof.

Larry came into the apartment to investigate the leak and found damage from not only the leak but also from the thrown baseball bat. Roger states that the baseball bat damage was a direct result of Larry’s inability to fix the leak based on his anger from Larry’s curt response. 

Suppose you are a mediator. In five to seven (5-7) pages discuss the rights and responsibilities of the landlord and the tenant in which you:

  1. Explore the legal rights and responsibilities of the tenant and the landlord. 
  2. Decide whether or not the landlord and / or the tenant had a legal duty to mitigate damages. 
  3. Determine whether or not Larry has legal grounds to evict Roger. Explain why or why not.  
  4. Describe whether or not Roger has a legal obligation to pay for the damage he caused and determine whether or not Larry would be liable for any direct damage. 
  5. Support each response with facts presented in the scenario.

Use the Internet to research criminal proceedings in England. Imagine you are traveling abroad in your chosen country when you witness a local national committing a violent assault. The criminal is arrested and charged by the police.

 

Upon returning to the United States, a professor in one of your criminal justice classes asks you to complete a written report on your experience.

 

Write a three to five (4) page paper in which you:

  1. Determine the pertinent demographic, social, political, and economic factors about your chosen country.
  2. Examine the manner in which your chosen country’s criminal code would likely view the crime you witnessed. Provide a rationale for the response.

What About the Contract?

 

 

 

Maynard, 18, was shopping for his first car. With a mere $4,000, he was hoping for a deal. He found a used convertible 1979 Mustang at Pierre’s Awesome Car Place for $5,000. Pierre claimed that the Mustang was “one of a kind” and “the best car in town.” He said “the engine and brakes are in tip-top shape.” Pierre even promised to bring the price down to $4,000, if Maynard agreed to buy it that very day.

 

Maynard immediately signed an agreement that contained an “as-is” clause and drove off in the car. Two days later, the brakes failed while driving and Maynard crashed into a tree. The front of the car was damaged and Maynard sustained mild injuries. Infuriated, Maynard immediately towed the vehicle back to Pierre’s and confronted him. Pierre shrugged it off, saying, “Too bad, bad brakes or not, you agreed to the “as-is” clause in the contract!”

 

Now Maynard does not know what to do. He has lost two weeks of work pay due to the injury, a damaged car that cost him $4,000, and physical pain and mental trauma. To make things worse, Maynard discovered the car’s fair market value was actually only $1,500 at the time of the purchase.

Here’s What Happened . . .

On the first of May this year, Centervale Police Officer Smith arrested Rosie Greene, a 15-year-old, for stealing several items from a local convenience store. This was just one of several incidents Rosie has been involved in this year. The majority of Rosie’s incidents have been centered on her schoolwork, fights, loitering, and truancy.

The principal has suspended Rosie several times from school. However, Rosie continues to engage in delinquent behaviors. Rosie’s arrest has been widely publicized in the newspaper and on television because Rosie ran from the police after they caught up with her while being truant from school and smoking behind a pizza shop.

You have been working with Centervale’s City Government to propose a plan to reduce juvenile delinquency and prevent further incidents of younger children becoming involved in delinquent behaviors as they grow up.

The principal has asked if you would help the School Board understand more about juvenile delinquency, the juvenile justice system, and particularly Rosie Greene’s situation to help them appropriately respond to parent’s questions and create a new policy. He has asked you to prepare a presentation for the Centervale City School Board’s next meeting.

For this assignment, prepare a PowerPoint presentation that details the history of domestic terrorism in the United States. In your presentation, discuss the two most infamous acts of domestic terrorism, the Oklahoma City bombings, and the attacks of September 11, 2001, which led to the creation of Homeland Security in 2003. CRJ 180: Alternatives to Incarceration

Recent study illustrates that nearly two (2) million juveniles are processed through juvenile courts across the United States each year. Depending on the nature of the crime, juveniles may face detention or incarceration if they are convicted. Given the fact that many courts are reluctant to incarcerate criminal offenders, judges often consider alternatives to incarceration. The driving force behind these alternatives is to save taxpayer money yet still demand offender accountability and impose sanctions for criminal behavior. 

 

Use the Internet or Strayer databases to research the use of sanctions other than incarceration or detention for juvenile offenders.
