Discussion Thread Question Assignment: Bivens and You

You are required to read the article on Bivens from Journal of Police and Criminal Psychology. The purpose of this article is to understand that a law enforcement officer is not immune from civil lawsuits.

Where once police and law enforcement agencies thought themselves immune, civil lawsuits against law enforcement officers are quite common nowadays. These lawsuits are based on whether the law enforcement officers correctly followed the guidelines meant to protect the citizens, guaranteed by the Constitution.

The purpose behind Bivens is to some extent protect private citizens from police misconduct. The other side of the coin is that if we so circumscribe the actions of officers, citizens may not be protected from the criminal acts of others. The point of the assignment is for you to begin to recognize this balancing act.

What You Are Required to Do . . .

Research on the Internet or the Argosy University Online Library and find some cases where officers have been sued in civil court for failing to follow the guidelines meant to protect the citizens from police misconduct.

Submission Details:

in a minimum of 250 words, post your responses to the following topics

  • Describe a lawsuit, the issues involved in the trial, and the verdict. Do you think public safety in terms of the safety of the public was improved? Why or why not?
  • As a law enforcement officer, what would your reaction be to being sued by a suspect in a case? How do you think that lawsuit would impact your personal life? How would you handle the pressure of being accused of violating the Constitution?
  • Do you think you might change the way you would act as a law enforcement official if you were aware that you could be sued by a suspect you apprehended? In what way would it impact your duties as a law enforcement official?

Sentiment Analysis

Find at least three online demos of Sentiment Analysis software.

Find at least three different movie reviews where the user also includes a score.  For example customer movie reviews on Amazon and Netflix use a 5 star rating system.  Copy and paste the text into the sentiment analysis demonstration software and compare the Positive/Negitive score from the sentiment analysis with the customer’s star rating.

  • In your post give an evaluation of each of the sentiment analysis applications.
  • In your opinion, which of the applications that you tested was the most accurate?
  • What are the limitations of sentiment analysis applications?
  • Given an example of how a company can use sentiment analysis.

Online examples of Sentiment Analysis demos:

  • Stanford University Sentiment Analysis
    • This website provides a live demo for predicting the sentiment of movie reviews.  This deep learning model buids up a representation of whole sentences based on the sentence structure.  It computes the sentiment based on how words compose the meaning of longer phases.
  • Text Processing – Sentiment Analysis
    • This sentiment analysis demonstration uses the Python programming language using NLTK to perform text classification.  It can tell you whether it thinks the text you enter expresses positive sentiment, negative sentiment, or neutral.
  • Lexalytics
    • This demonstration is provided by Lexalytics.  Their software is used for social media monitoring, reputation management, and voice of the customer programs.

LAW531 LAW/531 Contract Creation and Management Simulation. Business Standards Transcript

Speaker: Narrator, Robert “Bob” Johnson, Michael Smith

Narrator: Bob is a local used-car dealer and he’s feeling pretty good at the moment. He’s about to close a great deal with another used-car dealer, Mike. Mike has agreed to pay Bob more than he expected for a like-new car on his lot. The car’s on consignment from its owner, Al. Bob and Mike had talked about the deal over the phone and e-mail. During Mike’s visit to Bob’s dealership they settled on a final figure of $25,000.00. Once Bob received the payment, he would then write a check to Al for $22,000.00 and keep $3,000 as a consignment fee. All he had to do was say yes.

Mike: Sounds great. I can’t believe you’re letting this go for so little. I mean for $25,000 (pause) I feel like I’m stealing.

Bob: Yeah, right?

Mike: Take care.

Narrator: The next day when Mike got into his office, the phone rang.

Bob: Hey Mike, this is Bob. Hey, I know you were going to write me a check for $25,000, but could you write two checks instead? (Pause) One for Al for $22,000 and one for me for $3,000.

Narrator: Mike thought about it for a moment and came back with an unexpected response.

Mike: I’m going to have to reject your counteroffer, Bob. (Pause) No, we HAD a deal but you just rejected my original offer. (Pause). Look, there’s nothing on the table from my side anymore. (Pause) I tell you what? I’ll give you $20,000.
